Employment of Ex-Offenders and the Rehabilitation of Offenders Act

Because of the nature of the work for which you are applying, this post is exempt from the provision of Section 4(2) of the Rehabilitation of Offenders Act 1974 by virtue of the Rehabilitation of Offenders Act 1974 (Exemptions) order 1975.

Applicants are, therefore, not entitled to withhold information about convictions, which for other purposes are 'spent' under the Provisions of the Act, and in the event of employment, any failure to disclose such convictions could result in dismissal or disciplinary action. Any information given will be completely confidential and will be considered only in relation to an application for positions for which the order applies.

Whilst it is necessary to ask for information on convictions, this will not necessarily exclude you from being considered for employment.

Do you need permission to work in the UK?

Your employer will need to know if it is legal for you to work in the UK and whether you need a work permit or visa. You will need to show proof of your right to work. Some people are automatically entitled to work in the UK. Others may have restrictions on how long they can stay, whether they can work or the type of work they can do.

On 29th February 2008, the Government introduced some changes to the law on preventing illegal working. UK employers need to undertake document checks on all potential recruits and when you start a new job your employer may wish to carry out a number of checks to see if you are elegible to work in the UK.
